{"id":12022,"date":"2025-05-06T05:40:37","date_gmt":"2025-05-06T05:40:37","guid":{"rendered":"https:\/\/www.uxdesigninstitute.com\/blog\/?p=12022"},"modified":"2025-10-24T13:06:08","modified_gmt":"2025-10-24T12:06:08","slug":"news-alert-businesses-at-risk-eaa","status":"publish","type":"post","link":"https:\/\/www.uxdesigninstitute.com\/blog\/news-alert-businesses-at-risk-eaa\/","title":{"rendered":"News alert: Businesses at risk of legal claims as EU accessibility deadline looms"},"content":{"rendered":"<p><i>Today, we issued a press release on the looming European Accessibility Act deadline that was featured in <a href=\"https:\/\/www.irishtimes.com\/business\/2025\/05\/06\/businesses-run-risk-of-legal-action-under-new-digital-accessibility-rules\/#:~:text=The%20European%20Accessibility%20Act%20aims,the%20EU%20regardless%20of%20location.\" target=\"_blank\" rel=\"noopener\">The Irish Times<\/a> ,\u00a0<a href=\"https:\/\/www.independent.ie\/irish-news\/companies-at-risk-of-legal-action-if-websites-and-apps-not-user-friendly-for-those-with-disabilities\/a1230242612.html\" target=\"_blank\" rel=\"noopener\">The Irish Independent<\/a> and <a href=\"https:\/\/www.rte.ie\/news\/business\/2025\/0506\/1511252-accessibility-eu-directive\/\" target=\"_blank\" rel=\"noopener\">RTE<\/a>. <\/i><i>The press release can be found below.\u00a0\u00a0<\/i><\/p>\n<p><span style=\"font-weight: 400;\">Businesses are at risk of legal action from users as the June 28 deadline to meet the European Accessibility Act (EAA) fast approaches according to Irish tech company, the UX Design Institute.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Act aims to ensure digital equality across the EU by requiring websites, apps and digital services to meet certain accessibility standards<\/span><span style=\"font-weight: 400;\">, particularly for the <\/span><span style=\"font-weight: 400;\">22% of the population living with a disability.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As the deadline looms, the Dublin-based company warns that many businesses remain unaware of the serious consequences of non-compliance, including the risk for potential legal claims from individual users against non-compliant businesses in Irish courts.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A recent survey by Mason Hayes and Curran found that 58% of Irish businesses are not confident they understand the Act\u2019s requirements, and 42% lack the expertise to make the necessary changes<\/span><b>.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The EAA applies to\u00a0a wide range of industries \u2013 from e-commerce and banking to transport and media &#8211; and covers all companies operating within the EU regardless of location.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe requirements are not just technical features\u2014they\u2019re essential for enabling independent access to digital services,\u201d said Rachael Joyce, Head of Product and Research at the UX Design Institute, which is helping businesses prepare with a new Designing for Accessibility course.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIn Ireland, enforcement is particularly robust: not only can users initiate legal proceedings, but groups who advocate for accessibility can also back these cases.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cComplying with the Act means designing digital products that work for a wide range of physical and cognitive needs<\/span><b>. <\/b><span style=\"font-weight: 400;\">For example, websites should support screen readers for users who are visually impaired, offer keyboard navigation for people who cannot use a mouse due to mobility issues and include text alternatives to describe images for users who cannot see them.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ireland\u2019s enforcement framework is among the strictest in the EU, with serious or repeated breaches potentially carrying criminal penalties, including fines and imprisonment of up to 18 months.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While compliance may seem like an operational burden, Joyce stresses that accessibility should be viewed as a fundamental responsibility.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cAccessibility isn\u2019t about ticking boxes to avoid fines &#8211; it\u2019s about ensuring that everyone, regardless of ability, can navigate the digital world without barriers. It\u2019s something that will affect all of us at some point in our lives, whether due to disability, temporary injury, or age-related changes.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">She adds that a lack of understanding around accessibility standards is leaving businesses overwhelmed. \u201cThe guidelines can seem complex, and many organisations don\u2019t know where to start. The key is taking proactive steps now rather than waiting until legal action or enforcement catches up.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To help businesses and professionals bridge this gap, the UX Design Institute has launched a Professional Certificate in Designing for Accessibility. The 12-hour online course provides practical, expert-led training for product teams, developers, and business leaders who need to comply with accessibility standards.
